Terms of Service

1. Acceptance
By using abyssindex.com and its services (the “Service”), you accept these Terms. If you don't agree, don't use the Service. The provider is ABYSS Index; contact: info@abyssindex.com.
2. The Service
ABYSS Index is a software product (SaaS) offering educational information and data on market-cycle indicators (ABYSS Score, ABYSS Risk, on-chain metrics, charts). The core is free. “ABYSS Pro” is a paid subscription adding software features: personal alerts, an API key, embeddable widgets and an AI assistant. We do not custody, buy, sell or move crypto-assets or funds: we only publish information and a computed index.
3. Your account
Creator/Pro features require an account (managed by our identity provider, Clerk). You must provide accurate information and are responsible for your account's activity and for keeping your credentials secure. You must be of legal age in your jurisdiction.
4. Subscription, prices & payments
ABYSS Pro is billed recurrently (monthly or annually) or as a one-time payment (“lifetime”), depending on the plan. Payments are processed by our payment provider, which acts as merchant of record and handles applicable taxes. Prices are shown on the site; we may change them with reasonable prior notice, without affecting an already-paid period. The subscription renews automatically until you cancel.
5. Cancellation & refunds
You can cancel your subscription anytime; you keep access until the end of the already-paid period and it won't renew. Refunds are governed by our Refund Policy (/refunds).
6. Acceptable use
You may use the Service, widgets, images and API for personal or professional purposes while keeping attribution to ABYSS Index. You may not: use the Service unlawfully; attempt to harm, overload, breach or circumvent limits/security; resell access or reverse-engineer to replicate the Service; or use it in any way that infringes the law or third-party rights.
7. Intellectual property
The ABYSS brand, logo, design and published methodology belong to the project. The index and metrics are ABYSS's own data and are freely redistributable citing “ABYSS Index (abyssindex.com)”. Other software and content is protected.
8. No advice & no warranties
The Service is purely educational and informational. It is NOT financial, investment or tax advice, nor a buy/sell recommendation. Crypto-assets are volatile and high-risk: you may lose all capital. The Service is provided “as is”, without warranty of accuracy, availability or results. Past performance does not guarantee future results.
9. Limitation of liability
To the maximum extent permitted by law, ABYSS Index is not liable for indirect, incidental or consequential damages, nor for investment losses arising from use of the Service or decisions based on the information published. Nothing here limits liabilities that cannot be excluded by law (e.g. towards consumers).
10. Changes & termination
We may modify, suspend or withdraw parts of the Service and update these Terms; changes are posted here with their date. We may suspend accounts that breach these Terms.
11. Governing law & contact
These Terms are governed by Spanish law, without prejudice to any mandatory consumer rights in your country of residence. Contact: info@abyssindex.com.
